Service Agreement & Policies
Acceptance of Terms
By accessing and using the services of Kismet Pool & Patio, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Service Agreement
Kismet Pool & Patio provides pool cleaning, maintenance, repair, remodeling, and outdoor living space services throughout South Florida. All services are subject to availability and scheduling. We reserve the right to refuse service to any customer for any reason at our sole discretion.
Pricing and Payment Terms
All prices are subject to change without notice. Payment is due upon completion of service unless other arrangements have been made in writing. We accept cash, check, and major credit cards. A service charge may be applied to returned checks.
For recurring services, payment is due according to the agreed-upon schedule. Late payments may result in suspension of services and additional fees.
Scheduling and Cancellation Policy
Service appointments are scheduled based on availability and weather conditions. We will make every effort to maintain scheduled appointments but reserve the right to reschedule due to weather, equipment failure, or other circumstances beyond our control.
Customers may cancel or reschedule appointments with at least 24 hours notice. Same-day cancellations may be subject to a cancellation fee.
Property Access and Safety
Customer agrees to provide safe and reasonable access to the property and pool area. This includes ensuring gates are unlocked on service days, pets are secured, and any obstacles are removed from work areas.
Kismet Pool & Patio is not responsible for damage to landscaping, decorative items, or other property not directly related to pool and patio services unless caused by gross negligence.
Liability and Insurance
Kismet Pool & Patio carries appropriate liability insurance and workers' compensation coverage. Our liability is limited to the direct cost of services provided. We are not liable for indirect, incidental, or consequential damages.
Customer is responsible for maintaining their own property insurance. We recommend informing your insurance company of any pool or patio modifications.
Warranty and Guarantees
We guarantee our workmanship for a period of one year from completion date, unless otherwise specified in writing. This warranty covers defects in workmanship but does not cover normal wear and tear, damage from misuse, or acts of nature.
Equipment and materials are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer defects or warranty disputes.
Chemical and Equipment Use
All pool chemicals and equipment used by Kismet Pool & Patio meet industry standards and local regulations. Customers should not add chemicals to their pool on service days without consulting our technicians.
We are not responsible for damage caused by incompatible chemicals added by others or equipment misuse by the customer.
Emergency Services
Emergency services may be available outside normal business hours at additional cost. Emergency service requests will be evaluated based on urgency and technician availability. Additional charges apply for after-hours, weekend, and holiday service calls.
Permits and Regulations
Customer is responsible for obtaining any necessary permits for pool or patio work unless specifically agreed upon in writing. All work will be performed in accordance with local building codes and regulations.
Any work requiring permits will not commence until proper permits are obtained and fees paid.
Intellectual Property
All designs, plans, and proprietary methods used by Kismet Pool & Patio remain our intellectual property. Customers may not reproduce or distribute our designs without written permission.
Privacy and Confidentiality
We respect customer privacy and maintain confidentiality regarding property details and personal information. Please refer to our Privacy Policy for detailed information about data collection and use.
Dispute Resolution
Any disputes arising from our services will first be addressed through direct communication. If resolution cannot be reached, disputes will be resolved through binding arbitration in Palm Beach County, Florida, under Florida state law.
Force Majeure
Kismet Pool & Patio is not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to: severe weather, natural disasters, government regulations, labor disputes, or equipment failure.
Modification of Terms
These terms and conditions may be updated from time to time. Customers will be notified of significant changes. Continued use of our services after changes constitutes acceptance of new terms.
Service Areas
Our services are available in the following South Florida areas: Boca Raton, Boynton Beach, Delray Beach, Greenacres, Gulf Stream, Highland Beach, Lake Worth, Lantana, Manalapan, Palm Beach, Palm Springs, South Palm Beach, Wellington, and West Palm Beach.
Severability
If any part of these terms is found to be invalid or unenforceable, the remaining portions will continue in full force and effect.
Governing Law
These terms and conditions are governed by the laws of the State of Florida. Any legal proceedings will be conducted in Palm Beach County, Florida.
